These Website Terms of Use (“Terms”) govern your access to and use of the website operated by The Steward Club LLC (“The Steward Club,” “we,” “us,” or “our”) at www.steward-club.com (the “Website”).

By accessing or using the Website, you agree to these Terms. If you do not agree with these Terms, please do not use the Website.

The Website provides general information about The Steward Club, our philosophy of residential stewardship, and the nature of the services that may be available to qualifying properties and Members.

The Website is informational in nature. It is not an offer to provide services to every visitor or property, and the availability of stewardship may depend on factors including location, property characteristics, operational capacity, and our determination of whether a property is appropriate for membership.

Nothing on the Website guarantees that stewardship is available for a particular property or that an individual or property will be accepted for membership.

2. STEWARDSHIP AVAILABILITY INQUIRIES

The Website may allow you to submit information to ask whether stewardship is available for your home.

Submitting such an inquiry:

* does not create a membership;
* does not create a Steward-Member, agency, fiduciary, property-management, or other service relationship;
* does not constitute acceptance of a property for stewardship;
* does not constitute a proposal, quote, or guarantee of pricing;
* does not obligate The Steward Club to provide services; and
* does not obligate you to become a Member.

If we determine that stewardship may be available, we may contact you using the information you provided to discuss the Property, answer questions, and potentially arrange an Initial Home Assessment.

Any membership relationship will arise only after the applicable evaluation process has been completed and the parties have entered into a separate Membership & Stewardship Services Agreement.

3. INITIAL HOME ASSESSMENTS AND PRICING

Information presented on the Website is not a binding quotation or offer of membership.

The nature and requirements of stewardship may differ from one property to another. Membership pricing may therefore be determined individually after we have obtained sufficient information regarding the property, which may include an Initial Home Assessment.

Any proposal provided following such an assessment will be subject to its stated terms and the applicable Membership & Stewardship Services Agreement.

4. NATURE OF WEBSITE INFORMATION

The Website describes The Steward Club’s general approach to residential stewardship.

Website content is provided for general informational purposes only and should not be interpreted as professional advice regarding the condition, safety, value, design, construction, engineering, maintenance, repair, insurance, legal status, or regulatory compliance of any particular property.

Nothing contained on the Website constitutes:

* a home inspection;
* engineering, architectural, contracting, or trade advice;
* legal, tax, financial, or insurance advice;
* a warranty regarding the condition or performance of a property or its systems; or
* a substitute for evaluation by an appropriately qualified or licensed professional when such evaluation is warranted.

Descriptions of stewardship on the Website are general. The specific scope, terms, limitations, and responsibilities applicable to a Member will be governed by the Membership & Stewardship Services Agreement.

5. NO GUARANTEE OF PROPERTY CONDITIONS OR OUTCOMES

Residential stewardship is intended to provide continuity of observation, documentation, communication, and informed attention to a property over time.

No statement on the Website should be interpreted as a representation or guarantee that stewardship will identify, prevent, predict, or eliminate every defect, failure, loss, maintenance issue, safety concern, deterioration, emergency, or other condition affecting a property.

Homes and their systems may contain concealed, intermittent, inaccessible, latent, or rapidly developing conditions that may not be observable during ordinary stewardship activities.

Any specific obligations undertaken by The Steward Club will be governed exclusively by the applicable Membership & Stewardship Services Agreement.

6. INTELLECTUAL PROPERTY

The Website and its contents, including without limitation its text, written concepts, descriptions, photographs, graphics, designs, logos, crests, trademarks, service marks, branding, visual identity, and other original materials, are owned by or licensed to The Steward Club and are protected by applicable intellectual-property laws.

You may view the Website for your personal, non-commercial use.

Unless expressly authorized in writing by The Steward Club, you may not reproduce, republish, distribute, modify, display, transmit, create derivative works from, commercially exploit, or otherwise use Website content in a manner that infringes our rights or the rights of others.

Nothing in these Terms grants any license or right to use The Steward Club name, crest, logo, trademarks, service marks, or other brand elements.

7. ACCEPTABLE USE

You agree not to use the Website:

When you submit a stewardship-availability inquiry, you acknowledge the Privacy Notice and authorize The Steward Club to contact you by phone or email regarding that inquiry.

The Website may rely on or contain links to third-party platforms, websites, technologies, or services.

Nothing in this section modifies any express contractual obligation that The Steward Club may separately undertake in a duly executed Membership & Stewardship Services Agreement.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE STEWARD CLUB AND ITS OWNERS, OFFICERS, EMPLOYEES, REPRESENTATIVES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING SOLELY FROM YOUR ACCESS TO, INABILITY TO ACCESS, OR USE OF THE WEBSITE OR RELIANCE ON GENERAL INFORMATION PRESENTED ON THE WEBSITE.

Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited under applicable law.

This limitation concerns use of the public Website. Liability relating to stewardship services provided to a Member will be governed by the applicable Membership & Stewardship Services Agreement.

13. GOVERNING LAW

These Terms and your use of the Website are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

To the extent a dispute concerning the Website is not governed by a separate written agreement between you and The Steward Club, any legal proceeding concerning these Terms or the Website shall be brought in a court of competent jurisdiction in the State of Florida, subject to applicable law regarding jurisdiction and venue.

14. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in the Website, our operations, applicable law, or our practices.

When we update these Terms, we will revise the “Last Updated” date above.

Your continued use of the Website after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.

15. SEVERABILITY

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
